RESET COMMUNITIES OPEN CALL TERMS AND CONDITIONS

  1. The open call is open to any individual person or informal team of persons looking to make a change in their communities.
  2. The competition is open to citizens or permanent residents of the Republic of Cyprus.
  3. Once the selection of the winner(s) is completed, RESET will notify the winners of the award, in writing.
  4. The funding to be provided by RESET shall be distributed (as a lump sum or as installments), following the official approval, selection and announcement issued by RESET.
  5. Shortlisted applications will be invited to face-to-face pitching of their proposed project idea with the RESET Board before final announcement of winner.
  6. Following the selection of the winner, RESET has the right to request for additional face-to-face and/or online meetings in order to accomplish proper implementation of the project and ensure high quality results.
  7. The funding shall be distributed by RESET according to the needs of the project and, in any case, shall not be provided in advance of any particular project activity, unless decided otherwise by RESET.
  8. Any funds of the award that are not utilized during the implementation of the project shall be refundable to RESET.
  9. Each application and the proposed action/project/idea contained therein, should be free of elements that may violate or infringe upon the copyright of any other person or organization. The originality of the proposed action/project/idea remains in the applicants legal obligation and RESET has no liability related to the integrity and originality of the proposed action/project/idea.
  10. By submitting the application, the participant hereby confirms and agrees that the proposed action/project/idea and its original content, features and functionality are and will remain the exclusive property of RESET and that all rights, title and interest of all copyrights and trademarks are assigned to RESET. The applicant further agrees that RESET has the exclusive and irrevocable right to publish, transmit, distribute, modify, create derivative works and otherwise use, reproduce, disclose, sub-license, distribute, modify and exploit in electronic and print version, worldwide, and in any language and on any platform (electronic or not). The participant confirms that no other rights have been granted which could conflict with the right given to RESET.
  11. Following the announcement of the winning participant, the participant shall enter into a partnership agreement with RESET which shall form the entire agreement between the parties regarding and shall govern and set out the rights and obligations of each party regarding the action/project/idea.
  12. The proposed action/project/idea shall be completed within 6 (six) months and no longer, from the effective date of the above-mentioned partnership agreement.
  13. The submission will be made according to the guidelines of the Call for Participation.
  14. Personal Data Protection (GDPR) and Consent Statement: The personal data that will be received in the application and during the project, will be used and processed in the context and for the needs of the proposed action/project/idea only, as well as for the needs of its promotion on social media and the press. Personal Data will be retained only for the time necessary as prescribed in the GDPR laws and regulations and for the specified purpose(s) and will not be transferred to any third party. You have the right to receive information about how your personal data is processed, you have the right to access it, you have the right to correct any errors or request their deletion from the database, by contacting us at info@resetcy.com.
  15. By submitting the application, the applicant hereby acknowledges that, nothing in this Terms and Conditions shall be construed to require RESET to continue the awards program, after the effective date of the partnership agreement.
  16. The applicant agrees that RESET reserves the right, in its sole discretion, to amend or terminate any awards program, maintained by RESET in accordance to RESET COMMUNITIES program.
  17. The applicant agrees that, to the maximum extent permitted by law, RESET shall not be subject to any claim, whether in contract, tort or otherwise, arising out of the implementation of the proposed action/project/idea, and that RESET shall not be liable for any direct, indirect, consequential, special, exemplary or other damages that may arise from the enactment and implementation of the proposed action/project/idea, including, but not limited to, damages for economic loss.
  18. The applicant hereby acknowledge, confirms and agrees that it shall indemnify RESET and its directors, officers, employees, agents, affiliates and successors against any and all claims, demands, liabilities, judgments, losses, damages, costs, fees and expenses (including but not limited to reasonable attorneys’ fees) arising from or relating to any copyright infringement and/or any other omission related to the action/project/idea.
  19. The applicant hereby confirms and agrees that, any confidential information disclosed by RESET will remain the exclusive property of RESET and will only be used and/or disclosed by the applicant with the prior written consent of RESET. The applicant will not use the confidential information for any purpose that might be directly or indirectly detrimental to RESET or any associated affiliates or subsidiaries.
  20. The applicant acknowledges that disclosure of any confidential information or breach of any of the restrictive covenants or agreements contained herein and/or the partnership agreement will give rise to irreparable injury to RESET or its associates, inadequately compensable in damages. Accordingly, RESET, or where appropriate its associates and/or clients, may seek and obtain injunctive relief against the breach or threatened breach of any undertakings, in addition to any other legal remedies which may be available.
